First.- Information Society Services Law

In compliance with Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, and European Directive 2000/31/EC, it is hereby informed that the company that owns and manages this Website and App is SAFETROOP TECHNOLOGIES, S.L. (hereinafter “SafeTroop”), with CIF B44925204 and registered office at Carrer Espinoi 8/10 Local 1, CP 08024 (Barcelona), registered in the Mercantile Registry of Barcelona in book 1397 entry 1596.

Second.- Purpose of the Website and Apps

For the purposes of compliance with Law 34/2002, of July 11, on information society services and electronic commerce, hereinafter LSSI, SafeTroop informs you that the purpose of the Website is advertising and information about the services it provides, these being the management of applications to keep the units and services attached informed in real time, in order to provide support in emergency work and operational coordination.

The personal data that you provide us through the website will be processed exclusively to provide the requested information or, in the case of contracting the service, for the appropriate administrative management and monitoring of said service, as well as the billing and collection management thereof. In any case, the data accessed through the Apps for the purpose of providing the service is adequately protected, and cannot be tracked, geolocated or monitored unless the alert signal is activated.

Specific notice regarding HORUS (not a replacement for official channels):
HORUS is a technological support tool that allows the user, when an alert is activated, to transmit operational information (including, depending on the contracted/configured service, real-time location and audio and video transmission) for management by participating services. HORUS is not an official emergency channel and does not replace, nor is it intended to replace, official channels, including, but not limited to, 112 or 092. In the event of a real emergency or immediate danger, it is always recommended to prioritize contact with official channels (112/092) and follow the instructions of the competent authorities.

This legal notice establishes the conditions of use of the Website.

Third.- User access conditions.

The user undertakes to use the information contained in the Website and Apps for their own purposes exclusively, not carrying out any type of commercial exploitation other than the authorized uses. The User will be liable to SafeTroop or to third parties for any damages that may be caused as a result of the breach of this obligation.

The user of the Website will have the right to free and open access to the public information collected therein. However, SafeTroop reserves the right to restrict access to certain sections for the exclusive use of users with a customer account, intended for the contracting and management of the contracted service.

Four Limitation of liability.

SafeTroop makes every effort to ensure that its own content, or any third-party content included on the website, is free of errors. However, it does not guarantee or warrant the accuracy or suitability of this content, nor will it be liable for any consequences arising from its use.
SafeTroop is not responsible for the existence of viruses, worms, or any other similar elements. Users are solely responsible for implementing the necessary mechanisms to prevent damage to their equipment or information systems.
SafeTroop assumes no liability whatsoever for the transmission, dissemination, storage, provision, receipt, access, or use of the website and app, and in particular, for the following:

  • The existence of any failure in access, which causes an interruption, or programming, related to the Website and/or Apps and their operation, whatever its origin, any harmful element, or the intervention of a third party, as well as: server crash, updating and accuracy of data, maintenance work, insufficient capacity to support the computer systems necessary to use the service offered, or similar assumptions.

  • Carrying out acts of unfair competition and illicit advertising as a consequence of the transmission, dissemination, storage, making available, reception, obtaining or access to the Website and/or Apps or their contents.

  • The lack of veracity, accuracy, completeness, relevance and/or timeliness of the Website and Apps or their contents.

  • The possible lack of suitability for purposes or compliance with expectations that the Website and/or Apps or their contents could generate.

Specific limitation regarding the use of HORUS compared to official channels:
The use of HORUS is complementary and should not be used as a substitute for official emergency channels. SafeTroop does not guarantee that activating HORUS will result in immediate attention, response times, or effective intervention from third parties, nor that its use will be uninterrupted or incident-free, as it depends on technical factors (coverage, connectivity, battery, terminal configuration, and/or third-party systems). In case of emergency or immediate danger, it is recommended to call 112 or 092.

Sixth. – Links to Web and/or Apps

The introduction of links to the Website and/or Apps is not permitted. To establish any type of link, the interested party must have written authorization from the website administrators.

It is strictly prohibited, regardless of the type of link made to the Website and/or Apps, to establish frames, frames or any other mechanism that allows the display of content through a site other than the Website and/or App.

Seventh.- Use of the Web and/or Apps

With the limits established by law and in the Terms and Conditions established for this purpose, the user will assume all types of legal responsibility derived from the incorrect, inappropriate or illicit use of the Website and/or Apps, such as:

a) Using any device, software, virus, malware, or routine to interfere or attempt to interfere with the proper functioning of the website and/or apps,
b) The use of “phishing”, or impersonating another person by acting on their behalf,
c) The use of the website and/or apps to advertise through the presence of links, online marketing, or any other means that could involve the use of fraudulent advertising,
d) The publication of any content that is threatening or violent.

Eighth.- Consent and Jurisdiction

The user agrees to the conditions described and assumes any type of legal responsibility if he or she fails to comply with the terms described here.

These conditions are subject to the Laws of Spain. For any type of controversy arising from the use of the services offered or the contents of the Website and/or Apps, the competent jurisdiction will be that of the Courts and Tribunals of Barcelona or the user’s domicile.

Ninth.- Validity of the conditions of use

Las presentes condiciones de utilización de la Web y App tienen carácter indefinido.
No obstante, SafeTroop se reserva el derecho a modificar de manera unilateral estas condiciones cuando lo considere oportuno, en base a criterios legales doctrinales o jurisprudenciales. Any modification will come into force at the time it is published on the Website and/or Apps (as applicable), through this Legal Notice, Terms and Conditions or any other legal text included on the website or in the applications.
